Apple Developer End-User License Agreement (EULA)

This End-User License Agreement (“EULA”) is a legal agreement between you (“End User” or “You”) and [Your Company Name] (“Licensor,” “we,” “us,” or “our”) for the use of our software application (“Application”) made available through the Apple App Store. By downloading, installing, or using the Application, you agree to be bound by the terms of this EULA.
If you do not agree to the terms of this EULA, do not download, install, or use the Application.
1. LICENSE GRANT
1.1 Scope of License: The Licensor grants you a non-exclusive, non-transferable, revocable, limited license to download, install, and use the Application on any Apple-branded devices that you own or control, subject to the App Store’s Terms of Service and the terms outlined in this EULA.
1.2 Restrictions:
You may not copy, modify, distribute, or create derivative works of the Application.
You may not reverse engineer, decompile, or disassemble the Application.
You may not use the Application for any illegal, unauthorized, or unethical purposes.
2. INTELLECTUAL PROPERTY RIGHTS
2.1 Ownership: All rights, title, and interest in and to the Application, including but not limited to copyrights, trademarks, trade secrets, and other intellectual property, are owned by the Licensor or its licensors.
2.2 Third-Party Content: The Application may include content sourced from third parties. Such content remains the property of its respective owners, and you agree to comply with any applicable third-party terms.
3. DATA COLLECTION AND PRIVACY
3.1 Privacy Policy: The collection and use of your personal data through the Application are governed by our Privacy Policy, which is incorporated herein by reference.
3.2 Data Usage: You agree that the Licensor may collect, process, and use technical and usage data as described in the Privacy Policy to improve the Application’s performance and functionality.
4. APP STORE TERMS AND CONDITIONS
4.1 Compliance with Apple Terms: You acknowledge and agree to comply with the Apple App Store’s terms, policies, and guidelines.
4.2 Apple’s Role:
This EULA is between you and the Licensor, not Apple.
Apple is not responsible for the Application, its maintenance, or its content.
Apple has no obligation to provide any warranty for the Application except as required by law.
5. DISCLAIMER OF WARRANTIES
5.1 Educational Use Only: The Application is provided for educational purposes only and does not substitute professional advice or certified training.
5.2 As-Is Basis: The Application is provided “AS IS” and “AS AVAILABLE” without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. LIMITATION OF LIABILITY
6.1 To the fullest extent permitted by applicable law, the Licensor shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the Application.
6.2 In jurisdictions where limitations on liability are not permitted, the Licensor’s liability shall be limited to the maximum extent allowed by law.
7. TERMINATION
7.1 Termination by Licensor: The Licensor may terminate this EULA if you breach any term of this agreement.
7.2 Effect of Termination: Upon termination, you must cease all use of the Application and delete all copies from your devices.
8. GOVERNING LAW AND DISPUTE RESOLUTION
8.1 Governing Law: This EULA shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.
